The Potential Cost of Corporate Killing....The Sentencing Advisory Panel ('SAP') have announced a consultation on sentencing guidelines for the Corporate Manslaughter and Corporate Homicide Act which is proposing that firms found guilty of the new offence should be fined as much as 10% of their annual turnover. This could potentially lead to fines topping hundreds of millions of pounds. In addition, the SAP are advising that in every case the Court should impose a 'publicity order' on EVERY organisation convicted of this offence to advertise the conviction. This could lead to a serious double whammy of loss in terms of the effect of adverse publicity on revenue. |
